The Residence Concierge ("we", "us", "our", "the Company") provides a software-as-a-service platform that enables hotels to deliver AI-powered guest concierge services via WhatsApp. The platform includes automated guest messaging, partner booking management, a staff administration dashboard, and revenue tracking tools.
Our service operates through the Meta WhatsApp Business API and is subject to Meta's terms and policies in addition to these Terms.

The Service is offered on a monthly subscription basis. Fees are as published on our pricing page or as agreed in your service agreement. Payment is due monthly in advance. We reserve the right to suspend access to the Service if payment is overdue by more than 14 days.
All fees are exclusive of VAT, which will be added at the applicable rate. Refunds are not provided for partial months except at our sole discretion.
By using our Service, you agree to comply with Meta's WhatsApp Business Policy and Commerce Policy at all times. You acknowledge that:

Our use of personal data is governed by our Privacy Policy. In relation to guest data, you (the hotel) are the data controller and we act as your data processor. By using the Service, you acknowledge and agree to our data processing activities as described in the Privacy Policy and any Data Processing Agreement we execute with you.
All software, algorithms, interfaces, and content comprising the Service are owned by The Residence Concierge and protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes during the subscription term.
You retain ownership of your hotel's content, knowledge base entries, and guest data. You grant us a limited licence to process this data solely to provide the Service.
We aim to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. We are not liable for downtime caused by third-party services including Meta/WhatsApp, Twilio, or hosting infrastructure.
To the maximum extent permitted by law, The Residence Concierge's total liability to you for any claim arising out of or related to the Service shall not exceed the fees paid by you in the 3 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.
We are not responsible for the actions or omissions of service partners (taxis, restaurants, spas, etc.) booked through the platform. The platform facilitates bookings; the contractual relationship for services is between your guests and the relevant partner.
Either party may terminate the subscription with 30 days' written notice. We may suspend or terminate your access immediately if you breach these Terms or Meta's policies. Upon termination, you may request an export of your data within 30 days; after that period, data may be deleted.
We may update these Terms from time to time. Material changes will be notified to you by email at least 30 days in advance. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
These Terms are governed by the laws of Cyprus. Any disputes shall be subject to the exclusive jurisdiction of the courts of Limassol, Cyprus, unless otherwise agreed in writing.
